A woman from Abu Dhabi is required to repay a loan of Dh125,000

Abu Dhabi: The Abu Dhabi Civil Family Court ruled that a woman had failed to present any proof that the debt had been paid off and ordered her to return Dh125,000 to a man who had given her the money in several installments. Emarat Al Youm said that the dispute started when the man filed a complaint, claiming that the woman had borrowed Dh125,410 through multiple bank transfers from his account to hers, and demanded Dh125,410 in return along with court expenses. He used bank transfer records, WhatsApp messages, and other court-reviewed documentation to back his claim that she later refused to return the money despite numerous demands.

The defendant gave the court documents to review and filed a legal statement asking for the matter to be dismissed, but none of them demonstrated payback. The court ordered the plaintiff to take an additional oath during the proceedings, which is permitted by UAE civil evidence rules where papers show a claim is likely but not entirely conclusive. Under oath, the plaintiff declared that the woman had borrowed Dh125,000 and had not paid back any of it. The court stated in its decision that the plaintiff bears the burden of proof under UAE evidence law, while the defendant must present evidence to refute the claim.

The plaintiff’s sworn oath completed the evidence basis, and the bank transfers and written correspondence were judged adequate to prove the loan was made. Despite the defendant’s in-person appearance, the court stressed that she did not present legally sufficient evidence of payback. Consequently, the obligation continued to be unpaid. The court dismissed all other claims and ordered the woman to pay the plaintiff Dh125,000 as well as court fees and costs.
