Abu Dhabi:The court directs Dh87,383 to be paid for delinquent rent and cancels the car lease

Over the course of a three-year rental agreement, the defendant neglected to pay monthly rates and accumulated fines. Abu Dhabi: After determining that a young man had not fulfilled his financial duties under a long-term vehicle lease agreement, the Abu Dhabi Commercial Court ordered him to pay Dh87,383 to a car rental business. The Court of First Instance’s decision further mandated that the lease be terminated, that the defendant return the car to the rental firm, and that all infractions and black points he received while using the vehicle be added to his driving record.

According to Emarat Al Youm, the case originated from a lawsuit that the car rental company filed in November 2022. The lawsuit sought to cancel a three-year long-term lease agreement, return the vehicle free of defects, accidents, and traffic infractions, and transfer all black points associated with the vehicle to the defendant’s traffic code. Along with legal interest and monthly compensation until the vehicle was returned, the corporation also requested payment of unpaid rental fees, tolls, and traffic fines. The defendant had agreed to pay a monthly rental charge of Dh3,999, inclusive of VAT, for the term of the contract, according to the court’s rationale, which was verified by an advising expert hired by the court.

According to the expert assessment, the defendant accumulated traffic penalties and toll costs while in possession of the car and neglected to pay the monthly rent from the time he gained control of it until the end of September 2025. The court determined that the defendant had violated his contractual duties, which justified the lease’s termination. The court concluded that the confirmed amount owing was Dh87,383 based on the lease agreement and the expert assessment, notwithstanding the rental company’s initial claim of Dh92,362.

This includes outstanding rental fees of Dh71,970, traffic fines of Dh12,633, Salik toll charges of Dh2,652, and Darb fees of Dh128. Despite being given the chance to refute the stated sums, the court observed that the defendant did not offer any substantive defense or supporting documentation. In its final ruling, the court mandated that the defendant pay the confirmed sum plus three percent annual legal interest from the lawsuit’s filing date until the main amount was fully settled. Along with court fines and expert costs, he was also ordered to pay Dh3,999 in compensation per month starting on September 29, 2025, until the car is restored. Every other claim was rejected.
