The victim’s dignity and well-being were impacted by the defendant’s actions, which produced moral injury. Dubai: The Abu Dhabi Civil Family Court found a woman guilty of violating the victim’s privacy and verbally abusing her, causing moral and emotional injury, and ordered her to compensate another woman with Dh30,000. According to court documents, the plaintiff filed a case demanding Dh100,000 in damages, claiming that the defendant had insulted her and violated her privacy, leading her to submit a criminal report.
The defendant was later found guilty by a criminal court, which ordered the confiscation of the cell phone used in the event, fined her Dh2,000 for verbal abuse and Dh10,000 for invading the victim’s privacy, and required her to pay court fees, according to Al Khaleej Arabic daily. Following an appeal, the court upheld the majority of the sentence but changed it to impose a single Dh10,000 fine for the related offenses. After no appeal to cassation was made, the decision became final.
Because the defendant’s proven violation generated moral suffering that affected the victim’s dignity, reputation, and emotional well-being, the civil court reasoned that it was authorized to give a single total compensation encompassing all losses sustained. It concluded that Dh30,000 was appropriate recompense for the moral harm incurred.
