Changes to the H-1B visa for UAE nationals wishing to work in the US

As the US cancels the H-1B lottery, higher-paid, more specialized candidates will have greater chances.

Dubai: Professionals in the UAE and foreigners wishing to work in America may be directly impacted by the US’s planned changes to the way it grants H-1B work permits. The Department of Homeland Security said that it will replace the current random lottery system with a new selection procedure that gives preference to candidates with higher salaries and skill levels. The 2027 H-1B visa intake will be subject to the new regulations, which go into effect on February 27, 2026.

The H-1B visa: what is it?

Hiring foreign workers for specialized positions in fields like technology, engineering, healthcare, and finance is made possible by the H-1B visa. The US grants 65,000 visas annually, with an additional 20,000 set aside for individuals with advanced degrees from US universities. The government has depended on a lottery to determine who receives a visa because demand is much higher than supply; this approach has frequently left highly skilled applicants without a visa. The lottery is currently being discontinued.

What is evolving?

Applications for visas will be ranked under the new approach rather than chosen at random. The likelihood of obtaining a visa will be higher for jobs that pay more and call for specialized expertise.

Although they are less likely to be selected, lower-paid positions will nonetheless be eligible. According to US immigration officials, some firms submitted a lot of applications for lower-paying positions under the previous system, which was increasingly abused. According to a U.S. Citizenship and Immigration Services official, the modifications are intended to protect American workers and return the program to its original goals.

The reforms might have a big impact on UAE-based professionals, particularly those working in technology, engineering, finance, or healthcare. Strong credentials, specialized knowledge, and higher-paying job offers are likely to increase an applicant’s chances of success. Although there will be increased competition, those seeking for less senior or lower-paying positions can still be eligible.

Additionally, by limiting recruitment firms’ mass filings, the new regulations may make the process more transparent and predictable for individual applicants as opposed to large-volume sponsors.

The amendments raise the bar for US businesses. To attract international talent, employers may need to clearly define specialized tasks and provide more competitive compensation. According to the government, the objective for American workers is to keep wages from declining and make sure local jobs are not replaced by hiring from outside. The Trump administration’s broader initiative to strengthen oversight of the H-1B program includes the reform. In addition, some firms must pay an extra $100,000 per visa in order to be eligible.

Applications won’t be impacted right away, giving candidates and employers time to make adjustments prior to the 2027 intake.
