Compensation for bodily harm, lost wages, and psychological suffering is decided by the court. Abu Dhabi: A driver who struck a delivery rider while driving under the influence of alcohol was ordered by a civil court in Abu Dhabi to pay Dh30,000 in compensation. The event resulted in both physical harm and financial hardship. The driver, who had already been found guilty in a criminal court and fined Dh20,000 in addition to having his driver’s license suspended for a year, was ordered by the Abu Dhabi Family, Civil and Administrative Cases Court to reimburse the rider for both material losses and emotional suffering.
Emarat Al Youm claims that the victim was riding a motorcycle when the drunk driver struck him, causing damage to the bike, ruptured ligaments, and a total loss of earnings. After the collision, the plaintiff additionally alleged psychological injury and incurred medical costs. The delivery worker filed a civil complaint against the driver and his insurance provider, requesting quick implementation of the verdict, Dh100,000 in damages, and 5% annual interest. In order to make the motorist financially liable for any amount it might have to pay, the insurer then filed a subrogation claim.
The court observed that the driver’s liability had already been proved by the criminal conviction, which confirmed that he had been driving while intoxicated in violation of UAE traffic legislation and that his carelessness had resulted in injuries and damage to two vehicles. The extent of the claimant’s injury was confirmed by medical findings. The court noted that insurance companies are entitled to reimbursement if a driver causes an accident while under the influence of alcohol or drugs, citing UAE motor insurance legislation.
The court determined that Dh30,000 in compensation, along with legal fees, must be paid by both the motorist and the insurance provider. Within the parameters of the given compensation, the court’s ruling on the subrogation claim mandated that the driver reimburse the insurance for any money paid to the claimant.
