Abu Dhabi: A court in Abu Dhabi found two men responsible for an assault that resulted in bodily harm and ordered them to pay Dh60,000 in compensation. After the victim filed a civil case seeking Dh100,000 in damages for both bodily and moral suffering caused by the attack, the Abu Dhabi Family, Civil and Administrative Claims Court rendered its decision. The guys had already been found guilty in a related criminal case, according to court records, according to the newspaper. They were earlier convicted guilty of assault by the Abu Dhabi Court of First Instance, which also ordered them to pay court costs and fined each of them Dh8,000. The court described the legal foundation for compensation under the UAE Civil Transactions Law in its civil ruling, stating that culpability is created when three conditions are met: damage, fault, and a direct causal connection between them. The court stated that there is a duty to make amends for any act that wrongfully injures another person.

According to the ruling, fault is defined as not exercising the level of caution and care that one would expect from an average person. It further stated that damage encompasses moral harm, such as psychological distress or harm to one’s character and dignity, in addition to physical impairment. Proof that the harm would not have happened in the absence of the wrongdoing is necessary to establish causation. The court determined that compensation was warranted after examining the evidence and the type of injuries, but it lowered the requested sum and ordered the two men to split Dh60,000.
